VitalMind is not a medical device and does not provide medical advice. The insights, patterns, and suggestions provided by VitalMind are generated by artificial intelligence for informational and wellness purposes only. Always consult a qualified healthcare professional for medical decisions.

1. Agreement to terms

By accessing or using VitalMind ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Zealr Enterprise Inc, a Washington State limited liability company. If you do not agree to these Terms, do not use the Service.

2. Description of service

VitalMind is a health intelligence platform that connects wearable device data, food logs, and symptom tracking to provide personalized health insights for women with chronic conditions. The Service uses artificial intelligence to analyze health data, identify patterns, and generate wellness recommendations.

3. Not medical advice

VitalMind is a wellness and informational tool, not a medical device, diagnostic tool, or substitute for professional medical advice.

You acknowledge and agree that:

All insights, recommendations, and analyses provided by VitalMind are generated by AI and are for informational purposes only.
VitalMind does not diagnose, treat, cure, or prevent any disease or medical condition.
AI-generated content may contain errors, inaccuracies, or inappropriate suggestions. You should independently verify any information before acting on it.
VitalMind's observations about patterns in your data describe correlations, not causes. Individual health data cannot prove that one factor caused another.
You should always consult your doctor or qualified healthcare provider before making changes to your diet, exercise, medication, or health management plan.
In a medical emergency, call your local emergency number (911 in the US) immediately. VitalMind is not equipped to handle emergencies.

4. Eligibility

You must be at least 18 years old to use VitalMind. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

5. Your account

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information when creating your account and to update it as needed. You are responsible for all activity that occurs under your account. Notify us immediately at hello@vitalmindai.community if you suspect unauthorized access.

6. Acceptable use

You agree to use VitalMind only for its intended purpose as a personal health wellness tool. You agree not to:

Use the Service for any unlawful purpose.
Attempt to access other users' data or accounts.
Interfere with or disrupt the Service or its infrastructure.
Use the Service to provide medical advice to others.
Reverse engineer, decompile, or attempt to extract the source code of the Service.
Use automated tools to scrape or access the Service beyond normal use.

7. Wearable device integration

When you connect a wearable device (such as WHOOP or Oura), you authorize VitalMind to access your biometric data through that device's API. This authorization is governed by both these Terms and the wearable device provider's own terms of service. You can revoke this access at any time by disconnecting the device in VitalMind or through the wearable device's settings.

8. WhatsApp communication

If you use VitalMind's WhatsApp features, you agree that messages you send (including text, photos, and voice notes) will be processed by AI to provide the Service. Standard messaging rates from your carrier may apply. You can stop WhatsApp communication at any time by messaging "STOP" or by updating your preferences in the VitalMind dashboard.

9. AI-generated content

VitalMind uses AI models from third-party providers to generate health insights. You acknowledge that:

AI-generated content is produced algorithmically and may not always be accurate, complete, or appropriate for your specific situation.
The AI may identify correlations in your data that are coincidental rather than meaningful.
Suggestions about food, exercise, or lifestyle are general wellness observations, not personalized medical prescriptions.
The quality and accuracy of insights depends on the completeness and accuracy of the data you provide.

10. Data and privacy

Your use of VitalMind is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

11. Intellectual property

VitalMind, its design, features, and content (excluding your personal data) are owned by Zealr Enterprise Inc. You retain ownership of all personal data you provide to the Service. By using VitalMind, you grant us a limited license to process your data solely to provide and improve the Service.

12. Service availability

We strive to keep VitalMind available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by service interruptions.

13. Limitation of liability

To the maximum extent permitted by law, Zealr Enterprise Inc and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of VitalMind.

This includes, without limitation, damages arising from reliance on AI-generated health insights, decisions made based on VitalMind's analysis, inaccuracies in data processing or pattern identification, service interruptions or data loss, and integration issues with third-party wearable devices. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless Zealr Enterprise Inc from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Account termination

You may delete your account at any time by contacting hello@vitalmindai.community. Upon deletion, we will remove your personal and health data within 30 days in accordance with our Privacy Policy.

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. We will notify you before termination except in cases requiring immediate action.

16. Disclaimer of warranties

VitalMind is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, that AI-generated insights will be accurate, or that the Service will meet your specific health needs. You use VitalMind at your own risk.

17. Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of the State of Washington.

18. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Your continued use of VitalMind after changes take effect constitutes acceptance of the updated Terms.
